Chalk one up for the Davis campaign

The letter from Sir Simon Milton, head of the Local Government Association, to local councils telling them not to use the powers granted to them under the Regulation of Investigatory Powers Act to deal with “trivial offences” is a triumph for David Davis. (These powers were designed to assist in anti-terrorism investigations but are now being used by councils to check up on what people are putting in their bins and whether they are scooping up after their dogs.) Although, the letter might have been sent anyway there is no doubt that Davis has turned the spotlight onto these kind of abuses.

Davis is going to have to battle to stay in the news these coming weeks and I still think that his resignation was ill thought-out. But this letter does show that the state can be shamed into not using powers granted to it in a disproportionate manner.

As I pointed out elsewhere, the thing about anti-terrorost legislation, is that it is in fact just legislation.

RIPA is an offense in itself to any Englshman that values his liberty.

The LGA was preparing the letter before David Davis announced his decision to seek re-election. The decision to issue clear recommendations to local authorities stemmed from the earlier hostile press comment about Poole council, not from David Davis' comments.

Can anyone explain why such obtrusive powers are still permitted in terms of using cameras to penalize parking offences? Is it that the motorist is just too soft a touch not to spy on or does parking on a yellow line count as a non trivial offense?

this could very well be the flapping of a butterfly's wings [sorry, DD..] which causes the hurricane in Government.

A line has been drawn, and the LGA know that messing about with our personal liberties will not be tolerated any longer.

Y E S !!! . . . . . at last the message moveth, - a tweak in the right place works wonders! – ne’er mind (DB) that some apparatchik drafted a letter b4 DD announced, heartening tho’ that is, – the fact is that something is being DONE, - and please G*d, DD will keep the momentum moving.

Local Governments are using what is available to them.
If Labour wasn't so incompetent in drafting such legislation then Local Government would not be able to abuse their powers.
Or perhaps it was deliberate?

Oh really? So you're privy to the workings of the LGA?

Maybe you can tell us what other letters are being prepared by the LGA. There must be a good few thousand, surely, otherwise how could they possibly justify their existence and astounding large, tax-payer funded, stipends?

It's all about timing, innit?

Even if the LGA was thinking about this before the DD resignation, then there is no doubt that his stance has given it an extra force and prominence it would not otherwise possess.

I wonder if we shall see any more "clarifications" of interpretations and uses of intrusive laws before this by election is done and dusted?

Um, actually yes, I do get notified about the LGA's activities, both in general and specifically. As a member of a local authority, not least as one which also includes among its membership the LGA President, and as a delegate to the LGA annual assembly, it is important to know what it's doing.

In the absence of any news today that Boris has regained his backbone, - and therefore now reduced to a cipher, - DD offers the only hope of a clear voice of (commoners’ as opposed to elitist) reason.

Would this letter have been issued if David Davis had not launched his campaign.
